Nucleus Colony Deposit & Sale Terms

These terms govern all reservations, deposits, and sales of nucleus bee colonies (Nucs) by Ubiquity Enterprise Pty Ltd trading as Sydney Bees. By paying a deposit, the buyer agrees to be bound by these terms in full.
Reservation & Deposit
1.1 A non-refundable deposit of 50% of the total purchase price is required to secure a Nuc reservation. No reservation is confirmed until the deposit payment is received and a confirmation is issued by Sydney Bees.
1.2 Deposit amounts are as follows (GST inclusive):

Checkout amount includes a card processing surcharge of 1.7% + $0.30, reflecting Ubiquity Enterprise Pty Ltd's actual cost of card acceptance per the RBA surcharging standard. This surcharge is non-refundable.
1.3 A tax invoice will be issued upon receipt of deposit. The balance invoice will be issued at collection.
Balance Payment
2.1 The outstanding balance is due in full at the point of collection. Accepted methods: card (Visa/Mastercard) or cash.
2.2 Sydney Bees reserves the right to withhold release of the colony until full payment is received.
Collection
3.1 Collection is from: 12 Lemongum Place, Quakers Hill NSW 2763, by appointment only.
3.2 Sydney Bees will contact the buyer to schedule a collection window following deposit confirmation. Collection windows are offered Tuesday–Saturday.
3.3 The buyer must collect within 7 days of the agreed collection date. Failure to collect within this window without prior written agreement from Sydney Bees constitutes a forfeiture event under clause 5.
3.4 Title and risk in the nucleus colony pass to the buyer at the point of collection from Sydney Bees' premises. Ubiquity Enterprise Pty Ltd accepts no liability for colony condition, queen performance, or survival after that point.
Buyer Obligations at Collection
4.1 The buyer is responsible for providing suitable, ventilated transport equipment.
4.2 The buyer must present wearing adequate PPE (veil and gloves at minimum). Sydney Bees reserves the right to refuse collection to any person presenting without adequate PPE. Refusal on these grounds does not constitute grounds for a refund.
4.3 The buyer acknowledges that bees are live animals and accepts all associated risks from the point of collection.
Cancellation & Forfeiture
5.1 Buyer cancellation — more than 14 days prior to agreed collection date: Deposit is forfeited in full. No refund will be issued.
5.2 Buyer cancellation — 14 days or fewer prior to agreed collection date: Deposit is forfeited in full. No refund will be issued.
5.3 Buyer fails to collect within the 7-day window (clause 3.3): Deposit is forfeited in full. The colony will be returned to Sydney Bees' inventory and may be resold without further notice.
5.4 Buyer requests rescheduling: One reschedule request will be accommodated subject to availability, at Sydney Bees' sole discretion, provided the request is made in writing no fewer than 48 hours before the scheduled collection. A second reschedule request will be treated as a cancellation and the deposit forfeited in full.
Sydney Bees Cancellation & Force Majeure
6.1 If Ubiquity Enterprise Pty Ltd is unable to fulfil a confirmed reservation due to colony loss, disease, or circumstances within its reasonable control, Sydney Bees will provide the buyer with written notice and offer either:
(a) a substitute colony of equivalent specification; or
(b) a full refund of the deposit paid.
6.2 If Ubiquity Enterprise Pty Ltd is unable to fulfil due to a NSW DPI-mandated biosecurity restriction, including but not limited to a Varroa destructor emergency order, movement ban, or managed zone restriction applicable to the apiary location, the deposit will be refunded in full within 10 business days of the restriction notification. Ubiquity Enterprise Pty Ltd accepts no further liability in these circumstances.
6.3 Nothing in this clause limits the buyer's statutory guarantees under the ACL.
Australian Consumer Law
Nothing in these terms excludes, restricts, or modifies any right or remedy the buyer has under the ACL that cannot be excluded by agreement. Where Ubiquity Enterprise Pty Ltd fails to supply a colony conforming to the description provided at point of sale, the buyer's statutory rights remain intact.
Governing Law
These terms are governed by the laws of New South Wales, Australia. Any dispute arising from these terms is subject to the exclusive jurisdiction of the courts of New South Wales.
